Who we are

Empress Ecosystems LLC ("Empress," "we," "our," or "us"), a New Jersey, USA company, operates empress.eco. Swapp (swapp.eco) is a product of Empress Ecosystems LLC, not a separate entity — this policy covers both surfaces. It explains what we collect when you use the platform, why, and what your choices are.

What the platform is

Empress is a behavioral measurement service that records detailed user interaction data (xAPI statements) as core functionality — per-interaction, per-moment event streams are the product, not incidental analytics. When you use Empress or a product built on it (such as Swapp), your interactions with the platform are recorded as individual behavioral statements. This is deliberate, granular, and central to what the service does; we describe it here so there is no ambiguity.

Information We Collect

Information you provide directly:

• Account information (name, email), with authentication handled by Clerk
• Profile information and preferences
• Content and data you submit to the platform
• Communications with us (support requests, feedback, feature requests — these are stored)

Information recorded as you use the service:

• Behavioral interaction statements (xAPI) — the core record described above: what you did, when, and with what result, tied to a platform identifier
• On Swapp, guest play without an account, recorded under a device-scoped identifier kept in your browser; creating an account merges that guest history into it
• Device and browser information, IP address, and request logs, for security and reliability

How We Use Your Information

• Provide, maintain, and improve the service — including personalization built directly on the behavioral record
• Save your history and progress, and merge guest history when you create an account
• Send technical notices, updates, and support messages
• Respond to your comments, questions, and requests
• Detect, investigate, and prevent security incidents

Service Providers (Processors)

We do not sell your personal information. We use a small set of providers that process data on our behalf:

• Cloudflare — hosting, CDN, and storage
• Neon — database, including the behavioral statement store
• Clerk — authentication
• Resend — email and notification delivery, where used

We may also share information to comply with legal obligations, to protect our rights or safety, in connection with a merger or sale of assets, or with your consent.

Data Security

We use appropriate technical and organizational measures to protect your information, including encryption in transit and access controls. Data is processed in the United States.

Data Retention

Behavioral records are retained for as long as needed to run the service — they power history, progress, and personalization. Account information is retained while your account is active. When you request deletion, we remove or de-identify data tied to you, retaining only what is necessary to comply with legal obligations, resolve disputes, and enforce our agreements.

Your Rights

Depending on your location, you may have the right to:

• Access the personal information we hold about you
• Correct inaccurate or incomplete information
• Request deletion of your personal information
• Object to or restrict processing of your information
• Data portability

Children

Our services are for people aged 13 and over. We do not knowingly collect personal information from children under 13; if you believe a child has provided it, contact us and we will remove it.

Cookies and Local Storage

We use cookies and local storage needed for the service to work: authentication cookies set by Clerk, and (on Swapp) a device-scoped guest identifier and preferences in local storage. We do not use advertising or cross-site tracking cookies.

Governing Law and Changes

This policy is governed by the laws of the State of New Jersey, USA. We may update it from time to time; we will post changes on this page with a new effective date.
