Agreement to Terms

These Terms of Service ("Terms") are an agreement between you and Empress Ecosystems LLC, a New Jersey, USA company. Empress Ecosystems LLC operates empress.eco; Swapp (swapp.eco) is a product of Empress Ecosystems LLC, not a separate entity, and this one set of terms covers both surfaces (together, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of them, do not use the Service.

Description of Service

Empress is a behavioral measurement service that records detailed user interaction data (xAPI statements) as core functionality — this measurement is the product, not incidental analytics. Swapp is an interactive card platform built on it. By using the Service you agree that your interactions with it are recorded as described in our Privacy Policy. The Service is evolving; features and availability may change.

Age Requirement

You must be at least 13 years old to use the Service or create an account. We do not knowingly accept accounts from anyone younger; if we learn of one, we will close it and delete the associated data.

Accounts and Guest Use

Parts of the Service can be used without an account (on Swapp, under a device-scoped guest identifier — guest activity is measured too). Creating an account merges your guest history into it. If you register, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Transmit harmful, offensive, or illegal content
• Cheat, manipulate scores, or abuse or harass other users
• Attempt to gain unauthorized access to our systems
• Interfere with, overload, or disrupt the Service or servers
• Reverse engineer or decompile any part of the Service

Fair Play and the Ledger

Activity results are recorded on an immutable ledger to keep records, progress, and leaderboards honest. You cannot retroactively alter your recorded activity.

Virtual Items

Tickets and similar in-app items are virtual. They have no cash value, cannot be bought, sold, transferred, or redeemed for money, and we may adjust how they are earned or spent.

Your Data and Feedback

You retain your rights in content you submit to the Service. By submitting it, you grant us a limited license to use it to provide and improve the Service.

Feedback and feature requests you submit are stored and may be used to improve the Service, without obligation or compensation.

Intellectual Property

The Service and its original content, features, and functionality are owned by Empress Ecosystems LLC and protected by copyright, trademark, and other intellectual property laws. Our trademarks may not be used without our prior written consent.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMPRESS ECOSYSTEMS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Termination

You can stop using the Service at any time. We may suspend or terminate access for violations of these Terms. Upon termination, your right to use the Service ceases; you may request an export of your data by contacting us.

Changes to Terms

We may modify these Terms. We will post updated Terms on this page with a new effective date; continued use of the Service after changes constitutes acceptance.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New Jersey, USA, without regard to its conflict of law provisions.
